This website is developed and maintained by Arizona Public Service Company (hereinafter “APS,” “we” or “us”). When you use our website (“Website”), mobile apps, or other online properties, all collectively hereafter referred to as the “Sites,” APS may collect and use certain information about you. We recognize that privacy is important to you. This Privacy Policy describes our privacy practices relating to how we may collect and use your information, and your interaction with us through the Sites.

Residents of California should be aware that California law provides them certain rights regarding their personal information. Changes to this Privacy Policy
APS reserves the right to change this Privacy Policy at any time and encourages you to periodically review this Privacy Policy for any such changes. If APS makes material changes to this Privacy Policy that affect personal information we have previously collected about you, we will notify you by email or as otherwise required by applicable law. We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective immediately when it is posted (or upon notice if applicable). By your continued use of any of the Sites, you acknowledge that you have read, understood and agreed to be bound by the current policy posted on the Sites, at the time of your visit.

Information we collect about you
Information You Provide
We collect personal information you provide, such as your name, mailing address, phone number, survey responses, site activations, and the email address of those who seek to communicate with us via email.

We also collect other information that you choose to provide on the Sites, such as information about your home.

If you create an account on the Sites, we collect information about your use of our services. For example, in processing a payment with you, such information would include your name, amount of payment, and your bank account information, including account numbers, routing numbers, and similar information. Other information that we collect includes your transaction history, payment history, and account status.

If you contact us, request customer service, or otherwise provide us with information about yourself, we will maintain records of your correspondence. This may include any of your questions, comments, or suggestions.

Information automatically collected
We automatically collect certain information about your visits to our Sites, including your IP address, browser type, access times, and the pages you request.

We may also collect technical data and related information obtained from your device, such as the type of device you use, your device’s unique Device ID, your mobile operating system, the type of mobile Internet browser you use, and information about the way you use our Sites.

We may also collect information about your location and the location of your device. However, location functionality will not be activated unless you consent, via opt-in, to allow such functionality of the App to be used on your device.

Use of cookies
The Sites use cookies or analogous technologies such as web beacons, pixel tags, locally shared objects and clear GIFs to obtain certain types of information about your activity while on the Sites. "Cookies" are small pieces of information that are stored by your browser on your computer's hard drive. Our cookies enable us to facilitate access to different aspects of your account across our Sites. If you select the option for our Sites to remember your username and password, a cookie file will be stored on your hard drive after you log in. This allows us to re-populate your username and password on our login form, saving you the trouble of remembering it. You can choose to de-select this option at any time, which will delete the cookie file after you log in. Most web browsers automatically accept cookies, but you can usually change your web browser to not accept cookies.

We do not collect personal information about your online activities over time and across third party Web sites or online services. Therefore, “do not track” signals transmitted from web browsers do not apply to the Sites, and we do not alter any of our data collection and use practices upon receipt of such a signal.

How we use the information we collect about you
APS may use the information we receive or collect for a number of purposes, including for example to:
  • Provide you with the products or services that you request;
  • Operate, maintain, and improve the efficiency or effectiveness of the Sites or our products and services;
  • Perform analytics and conduct customer research;
  • Notify you about updates to our Sites or the products or services that you obtain from us;
  • Respond to your inquiries;
  • Contact you for informational or marketing purposes;
  • Prevent fraud or other illegal activities;
  • Enforce the Sites’ Terms of Use, end user license, and other agreements we have with you or to otherwise defend our rights or the rights of others;
  • Comply with applicable laws and APS’s corporate reporting obligations; or
  • Conduct other internal business purposes.
How we share your information
We may share your information with third parties, including:
  • To a parent company, subsidiaries, joint ventures, or other companies under common control with us;
  • With other companies that perform certain business-related services on behalf of APS (“Vendors”) including, for example, communicating with you or payment collection;
  • Where we determine that doing so is appropriate to enforce our Terms of Use, this Privacy Policy, or any other terms or contracts governing our relationship with you or are services; protect our property, services, and legal rights; prevent physical harm to the persons or property of others; or prevent fraud or other illegal activities against APS and others;
  • To support auditing, compliance, reporting, and corporate governance functions;
  • To comply with subpoenas, court orders, or similar legal processes;
  • To respond to requests from law enforcement agencies, regulators, and courts as allowed by or to comply with any and all applicable laws and regulations;
  • In connection with a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or business, or if we undergo bankruptcy or liquidation; or
  •  When you explicitly consent to the disclosure of your information to a third party.
How we protect your information
We strive to make the Sites secure by implementing an information security program that contains administrative, technical, and physical controls. But, information transmitted via the Internet and mobile platform channels is not always secure. Also, it may be possible for an unauthorized person to gain access to information about you notwithstanding our use of security measures. Therefore, please note that you enter information in the Sites at your own risk.

You can help protect yourself by being careful and responsible when you are online and by being aware that you are responsible for maintaining the secrecy of any passwords and account information you have regarding the Sites. We also advise that you use up-to-date virus scanning software on your computer to reduce the risk of encountering a virus through emails. APS accepts no responsibility or liability for any loss or damage arising from your transmissions of data, the use of email or their attachments, or for any viruses or errors or delays in the contents that result from such email and data transmissions.

Marketing opt-out
If you do not want to receive marketing emails from us in the future, please let us know by emailing us at [email protected]. We will remove your name from our email list. APS reserves the right to contact you should it become necessary for administrative purposes.

Correcting your information
Upon request, we offer visitors the ability to have inaccuracies corrected in contact information. Consumers can have this information corrected by calling us at the above telephone number or writing to us at the above address.

Protection of children’s privacy
Our Sites are general audience sites not directed at children under the age of 13. If we obtain actual knowledge that any information we collect has been provided by a child under the age of 13, we will take steps to promptly delete that information.

Links to third party sites
The Sites may contain links to other sites that are not operated or controlled by APS ("Third Party Sites"). Use of any information you provide to or on these Third Party Sites is governed by the privacy policy of the operator of those sites. Therefore, we encourage you to review that Third Party Site's privacy policy and terms of use whenever you visit such sites. APS is not responsible for the privacy practices or the content of Third Party Sites.

Third party information collection
Some content or applications on the Sites may be provided by third parties, including advertising companies, ad networks and servers, analytics companies, and application providers. These third parties may use cookies or other tracking technologies to collect information, potentially including personal information, about your activities over time and across different websites when you use our Sites. Those third parties may provide APS with data collection, reporting, ad response measurement, analytical information, and assist with delivery of relevant marketing messages and advertisements. The tracking technologies may also allow the third parties to deliver targeted advertisements of our products and services on other websites or on social media networks and gauge their effectiveness.

APS does not control these third-party technologies and their use is governed by the privacy policies of those third parties. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For more information about third-party advertising networks and similar entities that use these technologies, including information and resources to opt out of interest-based advertising see www.aboutads.info/consumers and www.networkadvertising.org/choices.

You may also opt out of tracking and receiving tailored advertisements on your mobile device by some mobile advertising companies and other similar entities by downloading the App Choices app at www.aboutads.info/appchoices. Please note opting out through these mechanisms does not opt you out of being served advertising. You may continue to receive generic ads while visiting our Sites and elsewhere online.

We have implemented Google’s Invisible reCAPTCHA technology on our Sites. Use of the Invisible reCAPTCHA is subject to the Google Privacy Policy and Terms of Use.

Social network account data
Our Sites may allow you to sign into and associate your social network accounts including, but not limited to, Twitter and Facebook with APS. By using this functionality, you give APS permission to access all of the elements of your social network profile information that you have made available to be shared and to use it in accordance with the social network’s terms of use and this Privacy Policy. Please refer to the privacy settings in your social network account for information about what data is shared with APS and other connected applications and to manage the data that is shared through your account, including information about your activities using our Sites. APS does not retain your username or password for social networking platforms for any longer than is necessary to complete an interaction. If you would like to disconnect a social media account from APS, refer to the settings of that social media account and its provider.

Our Sites may include social media plugins and widgets (“Features”). These Features may collect your IP address, which page you are visiting on our Sites, the date and time of your visit, and other browser- and device-related information whether or not you are logged into the relevant social media account. If you are logged into the relevant social media account, this data may be associated with your user name and may be used by the parties providing such Features for advertising purposes. Your interactions with these features are governed by the privacy policies of the relevant social media networks whose Features are included on the Site. This Privacy Policy is governed by the laws of the State of Arizona, without regard to conflicts of laws rules.
